- All users will be required to confirm agreement to the Terms and Conditions prior to use at the time of booking
- The Terms and Conditions shall permit the Client to use Middleton Dog Paddock (the Paddock) for exercising dogs under close personal supervision at all times.
- By using the Paddock, the Client shall automatically be deemed to agree to the terms and conditions.
- “Conditions” means these booking conditions which shall form part of the contract between the owner and the Client.
- The owner will have absolute discretion to permit or prohibit all types of activity on the land.
- A booking will be personal to the Client and may not be transferred or sub-let to any other person.
- Parking of vehicles will only be permitted in the designated parking areas.
- Clients will not be permitted climb on any gates, fences or posts at any time.
- The paddock will be available for use between the hours of 7am and 8pm weekdays and 8am and 8pm weekends and bank holidays from 01 May to 31 October and 7am and 6pm weekdays and 8am and 6pm.
- No more than 6 dogs may utilise the paddock at any one time with no more than 3 dogs per person.
- The paddock will be surrounded by a fence 5 feet high and have a return on the ground to keep dogs safe. Clients will be advised that if their dog(s) can jump high fences or is likely to dig themselves out then the paddock may not be totally secure. The owner will not accept responsibility for escaped dogs.
- Clients will be required keep the paddock clean and tidy and shall ensure that all litter and refuse generated is placed in the rubbish bins provided. All dog excrement MUST be picked up; poo bags will be provided and must be placed in the dog poo bin. Clients who fail to clear up after their dog(s) could result in the Client being banned from future use of the paddock.
- Clients will be informed that the ground is uneven in places and care must be taken. Clients using the paddock will do so at their own risk.
- Clients will be instructed to ensure that their dog(s) do not dig in any part of the paddock, at any time. If dog(s) are permitted to dig and cause significant damage, Clients will asked to inform the owners immediately to enable repairs to be made. Any Clients permitting damage to be caused may be banned from further use of the paddock.
- The boundary and security of the paddock will checked regularly, however, it will be matter for Clients to check that they are satisfied with the height, safety and condition of the fencing prior to use.
- Clients will not be permitted to interfere with or make any alteration to the layout or arrangement of paddock.
- Clients will be informed that they must ensure that no noise nuisance is caused to occupiers of nearby properties.
- At no time should a dog(s) be tethered to any structures on site i.e. fencing, posts, gates etc. – except at the designated areas.
- Dogs should not be left unattended at any time. Clients must accompany their dog(s) at all times, and must remain aware of what their pet is doing to ensure that they are safe and using the paddock in compliance with these terms and conditions.
- Site entry will be by means of a gate code, which will be sent via email the evening before a booked session.
- If a previous Client has not vacated the paddock and is there past the next start time Clients will be asked to call the owner on 07929 158828.
- The gate codes will subject to change at any time by the owner.
Payment
- Clients are required to pay for the booking in advance using the online system.
- Payments will be made via debit or credit card.
- All payments are non refundable.
Refusal of booking and re-scheduling of appointments
- Clients who do not turn up for their appointment or leave the paddock early will still be liable for the whole of the hire charge.
- The owner will reserve the right to refuse any application for the hiring of the paddock without being required to give any reason for such refusal.
- The owner will reserve the right to withdraw permission to use the paddock. The owner shall be under no liability for any expense incurred or loss sustained by the Client as a result of the cancellation at the owners’ sole discretion.
Emergencies
- The owner shall have the right to cancel any bookings in the event that the paddock is affected by an emergency/’act of God’ of any kind. The owner will refund any fees paid in these circumstances.
Right of entry
- The owner shall be allowed access at any time onto the paddock to carry out inspections and any decisions made by owner regarding safety and fitness of use will be binding. The owner will reserve the right to refuse admission to the paddock or evict any person from the paddock at his sole discretion.
Health and safety
- Clients shall have exclusive use of the paddock for their allocated booking. Under no circumstances should dogs be left on the premises unattended at any time.
- If a dog(s), or any it lives with, is showing any signs of ill health (diarrhoea, vomiting, kennel cough, general lethargy etc) Clients must re-schedule their appointment.
- If a dog(s) becomes ill following a visit to the paddock, Clients will be asked to contact the owner immediately to allow the paddock to be checked and disinfected if required for other dogs’ safety.
- Any children under the care and/or control of the Client are to be supervised at all times by the Client.
- Clients must not permit the operation or release of any high flying object without the prior written consent the owner, the Civil Aviation Authority and relevant Airports.
- Clients must not bring onto the paddock any article of an inflammable or explosive character or that produces an offensive smell, or CFC or any oil, electrical, gas or other apparatus.
Indemnity and insurance
- In keeping with the law regarding ‘responsible dog ownership’, Clients will be entirely responsible for their own and their dog(s)’ safety whilst on the paddock. Clients must always be in control of their dogs.
- The owner will not be responsible and will not accept liability for any loss, damage, injury or death howsoever and by whomsoever caused, whether to property or person(s) sustained by any person on the premises.
- Clients shall be responsible for all safety aspects of the paddock prior to, during or subsequent to the hire period and must accept liability for any loss, damage, injury or death howsoever and by whomsoever caused, whether to property or person(s) sustained by any person(s) utilising the paddock.
Dangerous Dogs
1. Dangerous Dogs Act 1991; the Control of Dogs (Scotland) Act 2010; Dangerous Dogs
(Northern Ireland) Order 1991, or any replacement legislation.
2. The dog must registered or specifically exempted from the applicable legislation and a copy of
the exemption order or certificate is delivered to the site owner;
3. A copy of the dog owner’s public liability insurance certificate for the dog is obtained and
retained by the site owner;
4. The dog handler ratio is 1:1 with their handler at all times unless with other dogs from the
same household;
5. The dog is kept on a lead and muzzled until the gate is shut when entering the exercise field;
6. The dog is put back on a lead and muzzled before opening the gate to leave the exercise field;
and
7. Only dogs from one household can use the exercise field at any one time.
Complaints Procedure

The complainant should set out in detail their cause for complaint. The site owner will confirm receipt of the complaint within five working days and will make every effort to resolve the complaint within 28 working days of receipt.
- If a site neighbour has cause for complaint in respect of a site users conduct leading to unreasonable neighbour disturbance, they are requested to contact the site owner in writing at the following address: G Tomley, Middleton Farm, Oswestry, SY11 4LT or by email : [email protected], or by telephone 07929 158828. The complainant should set out in detail their cause for complaint. The site owner will confirm receipt of the complaint within five working days and will make every effort to resolve the complaint within 28 working days of receipt.
- All complaints will be recorded and kept on file, together with a note of the outcome and actions taken. If a complaint a against a site user is upheld, the site user will be informed and advised that any further complaint made and upheld will lead to the user being refused further entry to the site.
- In respect of complaints made by site users regarding any matters relating to the condition of the site or the conduct of other site users, if these complaints are upheld, the resolution lies within the control of the site owner and appropriate actions will be taken to resolve the matters complained of and the complainant will be notified.
- The site owner contact details will be displayed on site at all times. The site owners are committed to ensuring that all contact details are kept up to date. All on-line and on-site information mediums will be updated immediately upon any changes to contact information.
Marketing and publication
- The owner will reserve the right to use any material, including texts and images sent (in any format) or via their Facebook page, web site and Instagram, for the purposes of marketing etc
Paddock Maintenance
- The paddock will be mown on a regular basis during the growing season. Client users will not be permitted access to the paddock whilst mowing is being undertaken.
- The wild flower meadow headlands will be managed seasonally to encourage wild grasses and flowers to self-seed and establish.
- Hedgerows will be cut annually and in accordance with routine farming operations. The roadside hedgerow will be allowed to gain hight to screen the paddock from the roadway.
